Restaurant raiders plead with judge to be sentenced

Two men have pleaded guilty to robbing a woman of £300 cash at the White Spoon restaurant in Cheltenham.
David Davison, 39, of no fixed abode, and Daniel Martin, of Finch Road, Innsworth admitted at Gloucester crown court on Friday, May 1, that they robbed Ms Purdey Spooner on April 28 this year.
Both men appeared over the video link from Hewell Prison, and their lawyers told Judge Ian Lawrie QC that they did not seek pre-sentence reports for their clients.
"Very sensible," the judge remarked.
However, the men wanted to be sentenced on the same day, which was not possible due to the limited time allocated for the hearing on the video link.
The judge said he would sentence them on Friday, June 8.
When he announced this, both men called out "over the video link please?"
The judge said "No, it will be here. It's a robbery. They will be produced in court."
However, lawyers for the two men urged the judge to reconsider, saying they had been making good progress on drug rehabilitation at Hewell prison since being remanded.
A production at court would mean they would then be moved to Horfield prison in Bristol, which is the local jail serving Gloucester crown court.
This would interrupt the men's drug treatment, they argued.
The judge said: "If verification of the treatment can be provided, then I am sympathetic.
"But I am not just taking it on a defendant's say so. I know they are so unkeen to go to Horfield."
Addressing the men over the video link, the judge said: "You cannot be dealt with today. We have a set time slot.
"I will adjourn your sentence to next Friday (June 8). Your counsel tells me you have been doing work on your drug problem.
"You must provide verification. If you do it will be video link. If not you will be produced.
"In the mean time you will remain in custody."
