Court rules residents must remove building

A court has upheld the decision by Forest planners ordering local residents, John and Celia Williams to remove a building from their land.

It relates to 'The Granary' on land at Eastwood Lodge Farm, Parkhill, Woolaston, which has been the subject of a long running dispute with the planning authority over its use as accommodation.

At a hearing at Cardiff High Court, Christian Hawley, barrister representing the district council, successfully defended the Judicial Review challenge to the council's decision to issue a Breach of Condition Notice.

The judge, Mr Justice Garnham QC, ruled in the council's favour on all three grounds of the Appeal and Mr and Mrs Williams' claim was dismissed. They were also ordered to pay the council's legal costs.

The court ruled that the appeal failed, which means that the Notice requiring demolition stands.
